Home buyers should review CC&R’s during due diligence period | Scottsdale

Many or most of our neighborhoods in the Scottsdale area have homeowners associations (HOA), and those neighborhoods have certain rules to obey.  To understand the “community rules” in a given neighborhood, a buyer should review the Covenants, Conditions and Restrictions provided by the HOA.
CC&R’s are the governing documents that dictate how the homeowners association operates and what rules the owner, tenants and guests must obey in a specific community.
Here are just a few examples of community-related concerns and questions we hear while helping clients search for a new home:

If you are working with an experienced Scottsdale Realtor®, he or she will likely already know the answers to your questions.
However, regardless of your real estate agent’s knowledge and experience, the only way to understand a community’s rules in detail is to review the CCR’s.  Be sure to do this during your due diligence period, or even before you enter into a contract, to avoid any surprises after the sale has gone through.
The Arizona Residential Purchase Contract gives the buyer an opportunity to review the most current set of CC&Rs, and to either elect to proceed with the transaction or cancel the contract.
The most important thing to determine is whether the CCR’s meets your personal needs and if you can live with the HOA’s restrictions.
